Terms of Service

These Terms of Service (“Terms”) govern your use of Plus One Party (the “Service”), operated by XN Digital LLC (“we,” “us”). By using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.

Plus One Party lets you create a party and grow its guest list through an invite chain. It’s currently offered free of charge. We may add, change, or remove features, and we may introduce paid features in the future. We’ll do our best to give notice of major changes, but we’re not obligated to maintain any particular feature.

You agree not to:

• Use the Service for anything unlawful, harassing, hateful, or fraudulent.
• Impersonate others or enter someone else’s information without permission.
• Upload content that infringes others’ rights or violates any law.
• Attempt to break, overload, scrape, or gain unauthorized access to the Service.
• Use the Service to send spam or unsolicited messages.

You’re responsible for the parties you create and the information you submit, and for making sure the people you invite are okay being invited.

You keep ownership of the content you submit (party details, names, Instagram handles, email address, and phone number). You grant us a limited license to host and display that content as needed to operate the Service. You represent that you have the right to share what you submit, and that any contact details you enter are your own.

When you join a party, the phone number you provide is shared with that party’s host so they can reach you about the event. By joining, you agree to receive messages from the host about that party.

If you’re a host, you receive guests’ phone numbers solely to coordinate your own party. You agree to use them only for that purpose, to comply with all applicable anti-spam, calling, and text-messaging laws, and to stop contacting anyone who asks you to. Don’t share guests’ contact details with anyone else or use them for marketing or any unrelated purpose. Any messages you send to guests are sent by you — through your own device or apps — not by Plus One Party.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We don’t guarantee that the Service will be uninterrupted, error-free, or secure, or that any party will reach its goal or take place.

To the fullest extent permitted by law, XN Digital LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the Service. Because the Service is free, our total liability for any claim is limited to one hundred U.S. dollars (US$100).

You can stop using the Service at any time. We may suspend or terminate access — including removing a party — if we believe these Terms have been violated or to protect the Service or its users.

These Terms are governed by the laws of the State of California and the United States, without regard to conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in California.

We may update these Terms from time to time. When we make material changes, we’ll update the date at the top of this page. Continued use of the Service after changes take effect means you accept the updated Terms.
